Glenview, Ill. // CHICAGOPRESSRELEASE.COM // July 27, 2011 — The Highway Commissioner of the Northfield Township Road District prevailed today over the Northfield Township Board of Trustees in Cook County Circuit Court Case Number 10CH38281.
Judge Nancy Jo Arnold issued a Memorandum Judgment Order confirming that the Township Board exceeded its statutory authority in reducing the Highway Commissioner’s budget for the Road District’s emergency management director.
Peter Amarantos, Northfield Township Road District Commissioner, filed suit against the Township Board in September, 2010, to seek to overturn the Board’s actions which capped the salary that the Road District could pay the emergency management director. The Highway Commissioner was represented in its lawsuit by Eric Anderson of the Chicago law firm Staub Anderson Green LLC.
According to Amarantos, “the primary concern prompting this litigation was the safety of the residents of Northfield Township.”
Anderson stated that “state law clearly gives the Highway Commissioner the decision making authority over the details of the areas of his responsibility.” Noting that the Township Board members only meet once a month, Anderson says “It is the Highway Commissioner’s full-time job to make sure these services are provided in the most effective manner. The Township Board has important functions, but determining the need for and qualifications of an emergency management director, or how much salt is needed for the upcoming winter season, are details better left to full-time professionals.”
