ALEXANDRIA, VA—Former CIA officer John Kiriakou was indicted today for allegedly repeatedly disclosing classified information to journalists, including the name of a covert CIA officer and information revealing the role of another CIA employee in classified activities, Justice Department officials announced. Kiriakou was charged in a five-count indictment returned by a federal grand jury in the Eastern District of Virginia, after he was initially charged in a criminal complaint and arrested in January 2012.

The indictment charges Kiriakou with one count of violating the Intelligence Identities Protection Act for allegedly illegally disclosing the identity of a covert officer and with three counts of violating the Espionage Act for allegedly illegally disclosing national defense information to individuals not authorized to receive it. The indictment also charges him with one count of making false statements for allegedly lying to the Publications Review Board of the CIA in an unsuccessful attempt to trick the CIA into allowing him to include classified information in a book he was seeking to publish.

Kiriakou, 47, of Arlington, Virginia, was a CIA intelligence officer between 1990 and 2004, serving at CIA Headquarters and in various classified overseas assignments. He remains free on bond and is expected to be arraigned on April 13, 2012 in U.S. District Court in Alexandria, Virginia.

The charges result from an investigation that was triggered by a classified defense filing in January 2009, which contained classified information the defense had not been given through official government channels, and, in part, by the discovery in spring 2009 of photographs of certain government employees and contractors in the materials of high-value detainees at Guantanamo Bay, Cuba. The investigation revealed that, on multiple occasions, one of the journalists to whom Kiriakou is alleged to have illegally disclosed classified information in turn disclosed that information to a defense team investigator and that this information was reflected in the classified defense filing and enabled the defense team to take or obtain surveillance photographs of government personnel. There are no allegations of criminal activity by any members of the defense team for the Guantanamo Bay detainees.

The indictment alleges that Kiriakou made illegal disclosures about two CIA employees and their involvement in classified operations to two journalists on multiple occasions between 2007 and 2009. In one case, by revealing an employee’s name as a CIA officer, Kiriakou allegedly disclosed classified information—as the employee was and remains covert (identified in the indictment as “Covert Officer A”). In the second case, Kiriakou allegedly disclosed the name and contact information of another CIA employee, identified in the indictment as “Officer B,” whose participation in an operation to capture terrorism subject Abu Zubaydah in 2002 was then classified. Kiriakou’s alleged disclosures occurred prior to a June 2008 front-page story in The New York Times disclosing Officer B’s alleged role in the Abu Zubaydah operation.

The indictment was announced by Patrick J. Fitzgerald, U.S. Attorney for the Northern District of Illinois, who was appointed special attorney in 2010 to supervise the investigation. He announced the charges with James W. McJunkin, Assistant Director in Charge of the Washington Field Office of the FBI. Together, they thanked the CIA for its very substantial assistance in the investigation, as well as the Air Force Office of Special Investigations for its significant assistance.

The Justice Department’s National Security Division, working with the FBI, began the investigation. To avoid the risk of encountering a conflict of interest because of the pending prosecutions of some of the high-value detainees, Mr. Fitzgerald was assigned to supervise the investigation conducted by a team of attorneys from the Southern District of New York, the Northern District of Illinois, and the Counterespionage Section of the National Security Division who were not involved in pending prosecutions of the detainees.

The count charging violation of the Intelligence Identities Protection Act, as well as each count of violating the Espionage Act, carries a maximum penalty of 10 years in prison, and making false statements carries a maximum prison term of five years. Each count carries a maximum fine of $250,000. If convicted, the court must impose a reasonable sentence under federal sentencing statutes and the advisory U.S. Sentencing Guidelines.

An indictment contains only allegations and is not evidence of guilt. The defendant is presumed innocent and is entitled to a fair trial at which the government has the burden of proving guilt beyond a reasonable doubt.

The government is being represented in court by Assistant U.S. Attorneys Iris Lan (Southern District of New York) and Mark E. Schneider (Northern District of Illinois) and Trial Attorney Ryan Fayhee of the Counterespionage Section of the Justice Department’s National Security Division. Assistant U.S. Attorney Lisa Owings (Eastern District of Virginia) will assist in the matter under local court rules.

The company set an aggressive goal to restore all customers by midnight Friday. However, there remain individual isolated outages in some heavily damaged pockets that will require more time to restore than initially expected. These outages will be restored throughout the day on Saturday.

“We came very close to reaching our goal of restoring all customers on Friday – reaching the 99 percent mark,” said Frank M. Clark, chairman and chief executive officer of ComEd. “We worked tirelessly this week to restore service to our customers as quickly and safely as we could and we will continue to work around the clock until the very last customer has been restored.”

“I fully understand and appreciate how difficult this has become for our customers,” Clark said. “For some of them we did not meet their expectations. We are continuously striving for ways to improve.”

Earlier this week, ComEd targeted restoring 75 percent of customers by midnight Wednesday and 95 percent by midnight on Thursday.  With a combined force of ComEd crews and crews from around the country, representing 14 states, the company met those goals ahead of schedule.

“ComEd has done a terrific job restoring customers who lost power after one of the most devastating storms on record, which unleashed damage comparable to what coastal utilities face in the wake of a violent hurricane,” said Tom Kuhn, president of the Washington-based Edison Electric Institute. “They may have set an industry standard in terms of the amount of dedicated resources and swiftness of their response.”

The company deployed more resources than at any other time in its history after Mother Nature unleashed a fury of heavy rain, 18,000 lightning strikes and wind gusts of 80 mph.  The storm toppled trees, snapped hundreds of utility poles and brought down miles of power lines.  For storms in other areas of the country with comparable wind speed and customer impact, restoration has ranged from seven to 10 days.

With ComEd crews, out of state utility workers, emergency response personnel, customer service reps and other support personnel, the cost of this massive effort will top $80 million, nearly twice the company’s annual storm budget.

Crews from around the country collectively traveled more than 8,000 miles to assist ComEd with its restoration effort.  Dedicated field personnel worked around the clock since Monday morning to bring customers back to service as quickly and safely as possible.  More than 5,000 ComEd employees and other personnel are contributing to the massive restoration effort.

CHICAGO, July 13, 2011 /CHICAGOPRESSRELEASE.COM/ — In the wake of a devastating storm that knocked out power to nearly a quarter of its customers Monday morning, ComEd today announced that it had restored power to 77 percent of customers as of early Wednesday morning. ComEd restored power to nearly half a million customers in the first 24 hours after the storm’s aftermath and expects to have 90 percent of affected customers restored by midnight on Thursday and 99 percent restored by midnight on Friday.

“We know how disruptive power outages can be for our customers’ lives and livelihoods,” said Chairman and Chief Executive Officer Frank M. Clark. “We will use all available resources in order to shorten the outage duration for customers remaining without power.”

Working day and night, ComEd restored approximately 675,000 customers as of 6 a.m. today.  More than 850,000 customers have been affected, making this one of the worst storm in terms of damage and customer impact, in the company’s history.

Remarkable in its brevity and force, the storm brought 18,000 lightning strikes and wind gusts of 80 mph causing extensive tree damage and bringing down power lines. The resulting outages are more difficult and time consuming to restore as they involve attention to more individualized equipment.

“Our crews have done an amazing job in swiftly restoring nearly half a million customers in just over 24 hours,” said Anne Pramaggiore, president and chief operating officer, ComEd. “The crews are working on 16-hours shifts and throughout the night to restore power as quickly and safely as possible.”

ComEd currently has approximately 700 crews in the field including mutual support from utilities in Indiana, Michigan, Pennsylvania and Wisconsin. Additional crews arrived today from Alabama, Florida, Kansas, Minnesota, Missouri, Ohio and Tennessee. More crews from Alabama and Georgia are expected to arrive over the next couple of days with the number of non-ComEd crews peaking at 370 on Friday.

The largest number of outages is located in the company’s northern and western regions. • Keep freezer and refrigerator doors closed and open them only when necessary. Food will stay frozen for 36 to 48 hours in a fully loaded freezer, if the door remains closed. A half-full freezer will generally keep food frozen for 24 hours.
• Customers who are on medical support equipment are strongly encouraged to evacuate to a place where they can be comfortable and safe.

WASHINGTON – The Postal Service said Friday it lost $8.5 billion last year despite deep cuts of more than 100,000 jobs and other reductions in recent years. The post office had estimated it would lose $6 billion to $7 billion, but a sharp decline in mail took a toll. Increased use of the Internet and the recession, which cut advertising and other business mail, meant less money for the agency.

For the year ending Sept. 30, the post office had income of $67.1 billion, down $1 billion from the previous fiscal year. Expenses totaled $70 billion, a decline of about $400 million. The post office also was required to make a $5.5 billion payment for future retiree health benefits.

“Over the last two years, the Postal Service realized more than $9 billion in cost savings, primarily by eliminating about 105,000 full-time equivalent positions — more than any other organization, anywhere,” chief financial officer Joe Corbett said in a statement. “We will continue our relentless efforts to innovate and improve efficiency. However, the need for changes to legislation, regulations and labor contracts has never been more obvious.”

The post office is currently in contract negotiations with two of its unions, with two more scheduled to be negotiated next year.

The loss of $8.5 billion in 2010 was $4.7 billion more than the previous year.

Mail volume totaled 170.6 billion pieces, compared with 176.7 billion in 2009, a decline of 3.5 percent. At the same time, volume was declining the post office was required to begin service to thousands of new addresses to accommodate population growth and new businesses.

The post office has asked Congress for permission to reduce mail delivery to five-days-a-week and to eliminate annual payments for future retiree health benefits. A request from the agency for a 2-cent increase in postage rates to take effect next year was recently turned down by the independent Postal Rate Commission. The post office has appealed that decision in federal court.

While the post office does not receive tax money for its operations it still must answer to Congress, which has been reluctant to agree to closing of local post offices and centers.

Sen. Tom Carper, D-Del., blamed the loss on the recession and “operating restraints placed on postal management.” The result, he said, may represent the most serious threat to the post office in its 200-year history.

“If corrective action is not taken quickly, the Postal Service will likely run out of cash and borrowing authority by this time next year, placing its ability to continue operations in serious jeopardy,” said Carper, who urged quick congressional action.

Rep. Darrell Issa, R-Calif., who is expected to head the House committee overseeing postal operations, said the loss “only underscores the urgent need for the Postal Service to trim its operating costs to match revenues.”

Fredric V. Rolando, president of the National Association of Letter Carriers, said the loss “comes as no surprise.”

“For the Postal Service to improve its financial situation, the government must let the USPS manage its financial affairs in the most effective manner possible, like any other business,” he said. “Essential to that process would be for Congress to fix an onerous congressional mandate from 2006, which obligates the Postal Service to make annual payments of $5.5 billion to pre-fund future retiree health benefits. No other institution in America, public or private, has to do this.”

Some have suggested privatizing the service, but the requirement to provide service everywhere in the country at the same price is not likely to be attractive to private companies.

Of particular concern has been the decline in the lucrative first-class mail, largely consisting of personal letters and cards, bills and payments and similar items. First-class mail volume fell 6.6 percent in 2010, 8.6 percent in 2009, and 4.8 percent in 2008. Traditionally, this mail has produced more than half of total revenue.

Volume for standard mail — advertising and similar business items — improved somewhat, indicating some signs of economic recovery, but generates less income.

Postmaster General John Potter, who retires in December, has developed a 10-year plan for the future of the post office, but parts of that plan require congressional action.
